Some experts theorize that millennials have more doubts about the longevity of marriage in general. Why should millennials view the traditional promise of „separate us to death“ with more skepticism than previous generations? This may be because millennials have faced divorce and its consequences more than any previous generation. Only 62% of millennials were raised by both parents, while 85% of baby boomers (born between 1946 and 64) were raised by both parents. Millennials have experienced divorces through their family and friends with historic heights, and they are not naïve and want to protect themselves from them. This may also explain why this generation did not rush to the altar. The marriage contract may be concluded by a woman and a man who have applied for registration of their marriage, as well as by the spouses. Minors who wish to conclude a marriage contract before registering the marriage must have a signed consent from their parents or guardian certified by a notary. Some federal laws apply to terms that may be included in a prenuptial agreement. The Retirement Equity Act (REA) of 1984, signed into law by President Ronald Reagan on August 23, 1984, reconciled confusion about whether ERISA preempted state divorce laws, thereby preventing pension plans from complying with court orders granting a spouse a portion of the employee`s pension in a divorce decree.  A prenuptial agreement may contain waivers whereby each spouse agrees to release all claims against the other party`s pension benefits arising out of the marriage under federal and state law, such as under the CSR. The 2014 report of the Legal Affairs Committee on Matrimonial Property generally accepted the Radmacher decision and recommended the creation by Parliament of a „qualifying marriage contract“ that would create a fully binding marriage contract as long as certain conditions were met.
The Commission`s recommendations have not yet been implemented. Many partners are uncomfortable reaching out to prenups for fear that they will harm their relationship or offend their future spouse. „However, for a successful marriage, it is important that couples are able to communicate well, even when it comes to unpleasant subjects. It must be proved that the parties had the legal capacity to conclude a contract and that it was not concluded by fraud, coercion or undue influence. Prenuptial mediation is an alternative way to conclude a marriage contract. In this process, a mediator facilitates an open discussion between the couple on all sorts of marriage-related issues, such as work expectations after the birth of children and saving and spending styles, as well as traditional premarital discussions about asset sharing and spousal support when the marriage is terminated. The engaged couple makes all decisions about what would happen in the event of separation or divorce with the help of the mediator. They then draft a memorandum of agreement or prenuptial agreement and have it reviewed by their respective lawyers. An agreement developed through mediation is usually more cost-effective because fewer hours are spent with the lawyers because the couple made all the decisions together and not on one side against the other. Pet clauses are now common in prenups and many states recognize pet custody in divorce decrees. „It`s interesting to see how a divorce agreement can be consensual on financial matters, but there are a lot of conflicts revolving around who gets the mini gold scribble!“ says Schneider. „There is now a California law that states that pets can be considered children to a large extent, so more people include a pet clause in their prenuptial agreements.“ With regard to financial matters related to divorce, marriage contracts are regularly confirmed and enforced by the courts in virtually all states. There are circumstances in which the courts have refused to apply certain parts/provisions of these agreements. For example, North Dakota`s divorce courts retain jurisdiction to change a restriction on the right to seek spousal support in a prenuptial agreement if doing so would result in the spouse who waived that right needing public assistance at the time of the divorce.  Florida and several other states include similar restrictions to prevent a departing spouse from becoming a ward of the state after a divorce under a prenuptial agreement.  In addition, in Florida, where the inheritance (electoral share) and property rights granted to surviving spouses under state law are so strong, the Prehusbandtal Agreement Act requires that a waiver of the surviving spouse`s rights set out in a marriage contract be enforced with the same formality as a enforceable will (notarized and evidenced by two uninvolved parties). .
